Participants

1. All participants must be resident Indian nationals only.

2. Eligibility Age - All participants must be over the age of 18 years on the quiz start date.

3. Employees of NGC Network (India) Pvt. Limited (hereafter the "Company"), STAR India Pvt. Limited, and its subsidiaries , or any of their associated companies, members of their families, and any consultants or advisors to any of the above entities and their relatives, and anyone directly associated with the quiz are not eligible to enter the quiz.

4. Participants and winners will be expected to provide the Company with such proof of identity, as the Company, in its sole discretion, may require. The Company reserves the right to demand passports, documents of proof of age (i.e. birth certificate, school leaving certificate etc.), etc. and will be entitled to disqualify the winner if, on verification, the details in the form are found to be different or untrue.

5. Non-conformity by any participant with the quiz rules and/or these terms and conditions will disqualify them from participating in the quiz. It shall be at the sole discretion of the Company to disqualify and/or restrain and/or refuse the participants entry and/or reject the right of the participant to enter in the quiz, if the Company is of the opinion that the quiz rules and/or the terms and conditions are not being fulfilled/ complied with.

6. The Company reserves the right to make amendments to the existing terms, conditions and/or quiz rules and/or extend the period of the quiz and/or cancel and/or discontinue the quiz or any part thereof without prior notice, and without any obligations of any nature, whatsoever, towards any person/participant.

7. The participant shall not have any criminal convictions and/or pending allegations of a criminal nature against him. In the event it is found otherwise, the Company reserves the right to disqualify the participant at any stage of the quiz, even after he/she may be short-listed or be declared a winner of the quiz.

Entries

8. Entries can be submitted only through the following mode:

9. Participants shall be bound by these terms, conditions and quiz rules for entering the quiz.

10. All entries for the question aired on a particular day must be received by 57827 on the same day itself. No correspondence / calls and/or communication of any nature, whatsoever, to the Company, will be entertained for any reasons whatsoever. Any entry received after the Closing will be invalid.

11. No subscription to the History Channel or other purchase is necessary for entry in this quiz.

12. Any entry made giving another person's (or a false) name or other dishonest information shall disqualify such entry. All liabilities and consequences arising on account of such misrepresentation will be the responsibility of the person submitting such incorrect or false information.

13. All entries that are submitted shall become the property of the Company.

14. The Company shall not be held responsible for any non-delivery of any SMS notification. Any SMS not finally received by the Company even if such SMS reaches the system of the SMS service provider will not be considered as a valid entry. The Company will entertain no correspondence of any nature regarding non-receipt of SMS and the Company shall have no liabilities of any nature whatsoever in this regard.

Winners

16. There shall be one winner daily selected by the Company based on lottery/lucky draw of the correct entries received.

17. On receipt of intimation from the Company that a particular individual is the winner of the quiz, such individual must acknowledge acceptance of the same within five (5) days of receipt of intimation. Failure to do so will be deemed as a non-acceptance of the prize, following which the Company reserves the right to award the prize to the next entitled individual, after the expiry of the said five (5) days, without issuing any further intimation to the first winner. No deviation from this said period of five (5) days shall be considered by the Company, for any reason(s) whatsoever.

18. Each entry shall be considered and judged individually. The Company's decision, in this regard, shall be final and no correspondence will be entertained in this regard.

Prize

19. The prize for the winning individual is one 31 inches Samsung LCD television, or a prize of similar nature and value in the event the advertised prize is not available due to any reason whatsoever. Prize shall not be home delivered and it shall be the responsibility of the Winner to collect the prize from the Company.

20. The Prize cannot be transferred, exchanged, encashed or redeemed by the winner in any manner or under any circumstances whatsoever and the winner must accept the Prize in the form and manner as set out in these rules, terms and conditions.

21. The winner will be liable for any taxes or surcharges that may be levied on the Prize and for any expenses not specified in the description of the prize herein. The winner will only be eligible to claim the prize once he/she produces to the Company the physical proof of having deposited the applicable TDS evidenced through an original challan /certificate on the value of the prize. Non-compliance with this provision will disqualify the winner from any claims whatsoever for the prize or otherwise.

22. The Company shall not be liable in any way for any failure or breach by any party in connection with this quiz or Prize and accepts no responsibility for any loss suffered by a participant arising from this quiz or the Prize.

Publicity & Personal Data

23. By entering the quiz, each of the participants agree to the use, by the Company, in any manner, for any purpose, at any time and in any medium:

(a) Their name and/or likeness, without compensation; and
(b) Their answers to the questions.

24. The winner and/or the Guest of the quiz agrees that he/she shall make himself/herself available from time to time and co-operate with the Company and participate in any activity and/or campaign ("Promotional Activity") of any nature whatsoever, without any compensation. Further, the winner or the Guest shall at no point of time refuse or disagree to participate in any such Promotional Activity for any reason whatsoever. The winner agrees that the footage of any nature with regard to the winner and/or the Guest shall vest with the Company, including but not limited to all intellectual property rights and any other rights for worldwide and in perpetuity.

Miscellaneous

25. Participants agree to indemnify the Company, its agents, employees, representatives, associates, affiliates, parent and subsidiary companies against any and all claims, losses, costs, damages, liability and expenses, if any, arising out of the participant's participation in this quiz. The Participants agrees that he/she shall hold harmless the Company, its employees, officers or any other person in connection with the quiz and shall also not file in person/ through any family member and/or third party any applications, criminal and/or civil proceedings in any courts or forum in India against the Company and/or the channel to claim any damages or relief in connection with the quiz or any matter related to it.

26. The winner may be required to complete the paperwork and give declaration and provide such indemnity as is specified by the Company in its sole and absolute discretion. In the event the winner does not fulfill this obligation, the winner will be disqualified from the quiz.

27. Each participant, by entering this quiz, expressly releases the Company from any claim, action or demand arising out of or in connection with the quiz or the prize, if any.

28. Disputes if any will be settled within the exclusive jurisdiction of the courts of Delhi and in accordance with Indian law. The participants, by entering the quiz, shall be deemed to have unconditionally waived the right to resort to any legal proceedings of any kind whatsoever outside Delhi for enforcing any claims or rights arising out of or in connection with the quiz, even if the participants reside outside Delhi or India.

29. This quiz is not open to the residents of States where such quizzes are not permitted under the applicable law.

30. The decision of the Company in relation to the quiz and the Prize shall be final and binding on all participants and their families and shall not be challenged/questioned on any ground.

31. The Company shall, in no manner whatsoever, be responsible and/or shall be held liable in any manner whatsoever, for any physical injury, death, and mental trauma caused to the winner in any manner whatsoever, including but not limited to, in connection with the quiz and/or the Prize.

32. The Company shall not be responsible or liable for any loss and/or damage of any entry/Prize, due to technical reasons such as disconnection, Act of God, Government actions, hacking, data corruption or other force majure circumstances, and will not be liable to pay any amount or compensation whatsoever to any participant for any loss arising therefrom.

33. The participation of the participant(s) in the quiz shall mean that the participant(s) has read, understood, accepted and agrees to abide with all the rules, terms and conditions of the quiz.

34. The participants(s)/ participant(s) agree that any dispute/difference regarding the quiz and/or the Prize and/or the rules, terms and conditions shall be referred to a sole arbitrator to be appointed by the Company which arbitrator shall have the exclusive jurisdiction to decide such a dispute. The venue of arbitration shall be New Delhi, India. The arbitration proceedings shall be governed by the Arbitration and Conciliation Act, 1996 and shall be conducted in English language. In case of any dispute / difference that cannot be settled through arbitration, the participants(s)/ participant(s) agree to submit to the exclusive jurisdiction of the Courts in New Delhi.
